Eternal AI offers usage-based pricing for its AI services as outlined on our website at eternalai.org. This policy governs all billing, payments, refunds, and related matters in connection with your use of the Services.
1. Billing, Invoicing, and Payment Terms
By using the Services, you agree to the following:
- You agree to pay all fees and charges incurred under your account in a timely manner.
- Eternal AI will charge you in the currency displayed at the time of purchase, via the payment method you provide.
- All invoices are due immediately upon issuance unless otherwise stated.
- All charges are non-refundable, except where required by applicable law.
- You are solely responsible for any applicable taxes, duties, or levies in your jurisdiction.
- You are responsible for maintaining valid and up-to-date payment methods associated with your account.
2. Use Limits, Overages & Suspension
- Each pricing tier may include usage quotas, request limits, or other usage-based restrictions.
- Eternal AI reserves the right to throttle, suspend, or block your access to the Services if your usage exceeds plan limits, threatens system stability, or negatively impacts other users.
- We may require you to upgrade your plan if your usage consistently exceeds the limits of your current tier.
- Continued use of the Services beyond your allocated limits may result in additional charges or temporary suspension of access.
3. Price Changes & Notice
- Eternal AI reserves the right to modify its pricing, fees, or usage policies at any time.
- Material price increases will be communicated with advance notice via email, in-app notification, or dashboard announcement.
- Price changes will not retroactively apply to charges already incurred prior to the effective date of the change.
- Your continued use of the Services after a price change takes effect constitutes your acceptance of the new pricing.
4. Refunds & Credits
Except as otherwise required by applicable law, all payments are non-refundable.
This includes, but is not limited to:
- Purchases of digital credits (“Diamonds”) or other in-app currency.
- Subscription fees or one-time payments for premium features.
- Payments made in error due to user negligence.
In exceptional circumstances, Eternal AI may, at its sole discretion, issue account credits or refunds on a case-by-case basis. Such decisions are final and do not establish precedent for future requests.
5. Disputed Charges
If you believe a charge is incorrect, you must notify Eternal AI in writing within 30 days of the statement or transaction date by contacting [email protected].
Your dispute notice must include:
- Your account information
- The date and amount of the disputed charge
- A clear explanation of why you believe the charge is incorrect
Both parties shall cooperate in good faith to resolve the dispute. Failure to notify Eternal AI within the 30-day period constitutes your acceptance of the charges.
6. Free Tier
Eternal AI may offer free or trial accounts at its discretion. If you are using a free-tier account:
- Your account may receive lower priority in resource allocation compared to paid accounts.
- We do not guarantee uptime, throughput, processing speed, or service continuity for free-tier usage.
- Eternal AI may modify, limit, or terminate free-tier offerings at any time, with or without notice.
- Free credits provided through daily check-ins or promotions have no cash value and cannot be transferred, sold, or redeemed for monetary compensation.
7. Currency and Payment Methods
- All prices displayed on the Services are in the currency indicated at the time of purchase.
- Eternal AI accepts payments via cryptocurrency and other methods as displayed on the platform.
- Exchange rates for cryptocurrency payments are determined at the time of the transaction and are not subject to adjustment after completion.
- Eternal AI is not responsible for any additional fees charged by your payment provider, bank, or cryptocurrency network (including gas fees or transaction fees).
