Terms of Service — Eternal for iOS

These Terms apply only to the Eternal application distributed through Apple’s App Store. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Apple Inc. and its subsidiaries (“Apple”) are not parties to these Service Terms. Your relationship with Apple is governed separately by Apple’s applicable terms.

Your license to use the iOS application is also governed by Apple’s Standard End User License Agreement. These Terms supplement that agreement. If these Terms conflict with Apple’s mandatory application-license terms, Apple’s mandatory terms control to the extent of the conflict. This webpage is not a custom App Store end-user license agreement.

You must be at least 18 years old and have reached any higher age of legal majority or digital consent that applies where you live. The Service is not available to minors. By using the Service, you represent that you meet these requirements and can enter into these Terms.

Eternal for iOS is an artificial-intelligence conversation and interactive storytelling application. AI personalities and their messages are generated by artificial intelligence and do not represent real people. The Service is not a real-person dating or matchmaking service.

Generated responses may be incomplete, inaccurate, unexpected, or offensive. The Service is provided for creativity and entertainment and is not professional medical, mental-health, legal, financial, or emergency advice. Do not rely on generated content for decisions where inaccurate information could cause harm.

You may use the Service to:

• Engage in lawful conversations with AI personalities.
• Create fictional scenarios and collaborative stories.
• Submit content that you own or have permission to use and share.
• Use available conversation-continuity features in accordance with the iOS Privacy Policy.

You may not use the Service to:

• Commit, facilitate, or promote illegal activity.
• Create, request, possess, or distribute content that exploits or sexualizes minors.
• Create or distribute non-consensual intimate content or content depicting sexual violence or exploitation.
• Harass, threaten, stalk, demean, or target people based on protected characteristics.
• Encourage self-harm or violence against another person.
• Impersonate a real person for harmful, fraudulent, or deceptive purposes.
• Disclose another person’s private or sensitive information without authorization.
• Evade safety measures, interfere with the Service, distribute malware, commit fraud, scrape at scale, or reverse engineer the Service except where applicable law expressly permits it.
• Infringe intellectual-property, privacy, or publicity rights.

Content or activity that violates these rules may be blocked, removed, or subject to access restrictions where enforcement tools are available.

Certain uploaded media may be submitted to automated safety checks. Messaging may also be temporarily restricted when service systems detect spam or abusive usage patterns. These measures do not detect or prevent every harmful interaction.

Eternal may warn, restrict, suspend, or terminate access when we determine that a user has violated these Terms, created risk for users or the Service, or must be restricted to comply with law. Safety concerns can be sent to [email protected].

You retain the rights you own in prompts, messages, images, audio, and other content you submit (“User Content”). You grant Eternal a worldwide, non-exclusive, royalty-free license to host, process, store, reproduce, transmit, display, and moderate User Content only as reasonably necessary to operate, secure, and improve the Service, comply with law, and enforce these Terms.

Conversation history and selected context may be retained to provide continuity across sessions. Do not submit passwords, payment-card numbers, government identifiers, or information you do not want processed. Deletion and retention are described in the iOS Privacy Policy.

Purchases and subscriptions made in the iOS application are processed through Apple. Apple’s billing, cancellation, and refund rules apply. You can manage or cancel a subscription from the subscriptions section of your Apple account.

Deleting your Eternal account does not automatically cancel an Apple subscription. You must cancel the subscription separately through Apple. Except where applicable law requires otherwise, refunds for App Store transactions are administered by Apple.

The Service, including its software, interface, designs, trademarks, and other materials provided by Eternal, is owned by Eternal or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms and Apple’s applicable license terms, no rights are transferred to you.

You may stop using the Service at any time. Eternal may limit, suspend, or terminate your access for violations of these Terms, threats to users or service integrity, legal requirements, fraud, abuse, non-payment, or discontinuation of the Service. Provisions that by their nature should survive termination will remain in effect.

The Service may change over time. Features may be added, modified, limited, or discontinued. We do not guarantee uninterrupted, error-free, or permanently available access, and maintenance or circumstances outside our control may cause interruptions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETERNAL WILL NOT BE LIABLE FOR INCIDENTAL, SPECIAL, EXEMPLARY, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. ETERNAL’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

Before initiating arbitration, you and Eternal agree to attempt to resolve a dispute informally for at least 60 calendar days after a written notice describing the dispute and requested resolution.

If the dispute is not resolved informally, it will be finally and exclusively resolved by binding arbitration administered by the Singapore International Arbitration Centre (“SIAC”) under its applicable rules. The arbitration will proceed on an individual basis, the governing law will be the laws of Singapore, and the award will be final and binding. Individual small-claims actions and requests for injunctive relief concerning unauthorized use or intellectual-property infringement are excluded from this arbitration requirement.

EACH PARTY MAY BRING CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

• Eternal, not Apple, is responsible for maintenance and support for the Service, except as applicable law requires.
• Eternal, not Apple, is responsible for addressing claims relating to the Service, including product-liability, regulatory, and intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of the terms governing your iOS application license and may enforce those terms against you.
• You must comply with applicable third-party terms when using the Service.
